The Historic Preservation Board of the City of LaFayette will hold a Public Hearing on Tuesday, May 5,

2026, at 5:30p.m. at Farmers Federation (Alfa Insurance) Building, 1006 Avenue A SE, LaFayette,

Alabama to consider the request on the following properties:

RESOLUTION NO. 2026-04-07-01

A RESOLUTION TO ESTABLISH RATES FOR 

SOLID WASTE COLLECTION SERVICES

WHEREAS, The City Council of the City Of LaFayette, Alabama is charged with the responsibility of providing citizens and customers with both adequate garbage and waste collection services; and

WHEREAS, in doing so, the City of LaFayette has contracted to provide garbage collection and has equipment and facilities for the collection of other waste.  It is prudent that the City of LaFayette continue to maintain and improve said equipment and facilities, pay the costs of the operation thereof, and pay the cost of the contracted services using primarily the fees derived from its citizens and customers; and

WHEREAS, the City Council of the City of LaFayette, Alabama finds that it is prudent to periodically review its rates and to adjust the same in order to properly pay the contract obligations, costs of maintenance, construction, improvement, operation, and debt service (if any) associated with said collection services; and

WHEREAS, the City Council of the City of LaFayette, Alabama recently contracted for the collection of municipal solid waste from residential customers and for light commercial entities defined as follows, a business entity within the City that generates a volume of municipal solid waste that can be adequately accommodated by one or more Roll Out Carts and not in the business of preparing food for resale; and

WHEREAS, the City of LaFayette operates equipment and facilities for the collection of other waste within the city and has purchased additional equipment, repaired existing equipment, initiated cost reducing measures, continues to maintain and improve said equipment and facilities, and anticipates incurring additional operating costs, some of which include raises for certain city employees; and

WHEREAS,  the City Council of the City of LaFayette, Alabama has conducted a review of said rates and the prospective eligibility of light commercial entities to have access for waste collection commiserate with residential customers and finds that an adjustment of said rates is necessary and proper and that light commercial entities should have access for waste collection commiserate with residential customers; and

WHEREAS, in accordance with Ordinance 481 of the City of LaFayette the monthly waste and garbage collection rates may be changed by the adoption of a resolution of the City Council and publication of said rate change for three consecutive weeks following the adoption of said resolution;

NOW THEREFORE, BE IT HEREBY RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF LAFAYETTE, ALABAMA, AS FOLLOWS:

SECTION ONE. That light commercial entities within the City that generate a volume of municipal solid waste that can be adequately accommodated by no more than two 90 gallon or less roll out carts shall be eligible for solid waste collection by the City of LaFayette.   Such roll out carts shall be supplied by the City of LaFayette or its contractor. Light commercial entities in the business of preparing food for resale shall not be eligible for solid waste collection by the City of LaFayette.

SECTION TWO.

That in accordance with Section Five of Ordinance 481 of the City of LaFayette the monthly waste and garbage collection rates for each residence and light commercial entity shall be Thirty-five and 00/100 Dollars ($35.00) beginning June 1, 2026.

SECTION THREE.

The rate schedule contained in Section Two of Ordinance 481 shall not be effective after May 31, 2026.

SECTION FOUR.

Each customer shall be charged an additional fee of Nine and 00/100 Dollars ($9.00) each month for a second roll out cart.

SECTION FIVE. Every third August after the effective date hereof said rates shall increase by ten percent (10%).  Sixty days (60) prior, but not more than one hundred eighty (180) days prior to any such increase the city clerk is to provide a notice of the imminent increase by placing said notice on the agenda of the next council meeting.

SECTION SIX. The City Clerk of the City of LaFayette is hereby authorized and directed to cause a copy of this Resolution to be published in THE LaFAYETTE SUN, a newspaper published in and of general circulation in the City of LaFayette, Alabama a minimum of three weeks prior to the effective date hereof.

WHEREAS the Alabama Legislature at its 2025 Regular Session enacted Act No. 2025-227 

(SB118) and Act No. 2025-291 (HB354), proposing amendments to the Constitution of Alabama of 2022; 

WHEREAS, in conformity with Section 284 of the Constitution of Alabama of 2022, as amended, 

the Legislature has ordered an election by the qualified electors of the state upon such proposed 

amendments; and 

WHEREAS notice of this election, together with the proposed amendments, is required by law 

to be given by proclamation of the Governor, which shall be published once a week for at least four 

successive weeks immediately preceding the day appointed for the election; 

NOW, THEREFORE, I, Kay Ivey, as Governor of the State of Alabama, do hereby give notice, 

direct, and proclaim that on Tuesday, May 19, 2026, an election will be held in the State of Alabama in

amended; and aggravated child abuse, as provided in subsection (b) of Section 26-15-3.1, Code of 

Alabama 1975, as amended; and shooting or discharging a firearm, explosive, or other weapon into an 

occupied dwelling, building, railroad locomotive, railroad car, aircraft, automobile, truck, or watercraft, 

as provided in Section 13A-11-61(b); and that excessive bail shall not in any case be required.

Section 160. 

(a) A district attorney for each judicial circuit shall be elected by the qualified electors of those 

counties in such the circuit. Such The district attorney shall be licensed to practice law in this state and 

shall, at the time of his or her election and during his or her continuance in office, shall reside in his or 

her circuit. His The term of office shall be for six years. and he He or she shall receive such compensation 

as provided by law; provided, the compensation shall not be diminished during his or her official term. 

Vacancies in the office of district attorney and in his or her staff shall be filled as provided by law. 

(b) Clerks of the circuit courts shall be elected by the qualified electors in each county for a term 

of six years. If the office of register in chancery continues to be provided by law then the clerk of the 

circuit court may also fill such the office in a manner prescribed by law. Vacancies in the office of clerk 

of the circuit court shall be filled by the judge or judges of the circuit court who have jurisdiction over 

the county in which the office of clerk of the circuit court is located. 

(c) Persons Individuals elected to the position of constable to assist the courts of the state as 

provided by law shall be subject to the same restrictions, rights, and limitations as are specified in 

section Section 280 of the Constitution of 1901 Alabama of 2022, and no law shall prohibit the receipt of 

fees for the performance of official duties of said the position while holding any other elected or 

appointed office. 

(d) The revenue from fines, forfeitures, and court costs produced in district courts from the 

exercise of jurisdiction under municipal ordinances shall be apportioned between the municipality and 

the state as shall be provided by law.

four successive weeks immediately preceding Tuesday, May 19, 2026, in every county as required by
