Should a conflict arise between the property address and the legal description, the legal description will control.

Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), the right of redemption of any taxing authority, all outstanding liens for public utilities which constitute liens upon the property, any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, easements, rights-of-way, zoning ordinances, restrictions, special assessments, covenants, the statutory right of redemption pursuant to Alabama law, and any matters of record including, but not limited to, those superior to said Mortgage first set out above. Sealed proposals for this project shall be received by Dr. Sharon Weldon, Chambers County School District, 1298 Vocational Drive, Lafayette, AL 36862, until 2:00 PM Central Time, Thursday, October 16, 2025, then opened and read aloud.

All General Contractors bidding on this project shall be required to visit the site(s) and examine all existing conditions prior to submitting their proposal and shall be arranged by the contractor with the owner.

All Bidders shall have general liability and workman’s compensation insurance. The project shall be bid excluding taxes. Bids must be submitted on proposal forms furnished by the Architect or copies thereof. No bid may be withdrawn after the scheduled closing for receipt of bids for a period of ninety (90) days. The Owner reserves the right to reject any or all proposals and to waive technical errors if, in the Owners judgment, the best interests of the Owner will thereby be promoted.

A certified check or Bid Bond payable to Chambers County School District in an amount not less than five percent (5%) of the amount of the bid, but in no event more than $10,000.00 must accompany the bidder’s sealed proposal. Performance and statutory labor and material payment bonds will be required at the signing of the Contract.

All bidders bidding in amounts exceeding that established by the State Licensing Board for General Contractors must be licensed under the provisions of Title 34, Chapter 8, Code of Alabama, 1975 and must show evidence of license before bidding or bid will not be received or considered by the Architect. AN ORDINANCE OF THE CITY OF LAFAYETTE, ALABAMA, TO EXEMPT CERTAIN “COVERED ITEMS” FROM THE MUNICIPAL SALES AND USE TAX

BEGINNING AT 12:01 A.M. ON FRIDAY, FEBRUARY 20, 2026, AND ENDING AT TWELVE MIDNIGHT ON SUNDAY, FEBRUARY 22, 2026, AS AUTHORIZED BY ACT 2012-256, GENERALLY REFERRED TO AS THE STATE SALES TAX HOLIDAY FOR SEVERE WEATHER PREPAREDNESS LEGISLATION.

BE IT ORDAINED by the City Council of the City of LaFayette, Alabama as follows:

SECTION ONE: In conformity with the provisions Act 2012-256 enacted by the Alabama Legislature during the 2012 Regular Session, providing for a State Sales Tax Holiday, the City of LaFayette, Alabama, exempts “covered items” from municipal sales and use tax during the same period, beginning at 12:01 a.m. on Friday, February 20, 2026 and ends at 12:00 midnight the following Sunday, February 22, 2026.

SECTION TWO: This Ordinance shall be subject to all terms, conditions, definitions, time periods, and rules as provided by Act 2012-256, except that the time period shall only be as specified in Section 1 above and not for all years thereafter.

SECTION THREE: The City Clerk is hereby authorized and directed to certify a copy of this Ordinance under the seal of the City of LaFayette, Alabama, and to forward said certified copy to the Alabama Department of Revenue to be recorded and posted on the Department website.

SECTION FOUR: Once published as provided by law this Ordinance shall become effective February 1, 2026.

Ms. Shelby Peterson, East Alabama Regional Planning and Development Commission Principal Planner, and other representatives from her office will be in attendance to continue the LaFayette Comprehensive Plan process. This meeting will consist of reviewing the Future Land Use map draft, survey results, and housing goals discussed at the September 9, 2025 meeting.
